Terms Of Service

By creating an account or placing an order, you agree to receive transactional communications from MAGA, including order confirmations, shipping updates, and customer service responses. These communications are necessary for order fulfilment and cannot be opted out of while you maintain an active account or open order.

You may also receive marketing or promotional materials from MAGA. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email or by contacting us at contact@maga.com. Opting out of marketing communications will not affect transactional or service-related messages.

Any contests, sweepstakes, or other promotions ("Promotions") made available through the Service may be governed by rules separate from these Terms. If you participate in any Promotions, please review the applicable rules alongside our Privacy Policy. In the event of a conflict between Promotion rules and these Terms, the Promotion rules will take precedence for that specific Promotion.

By posting Content on or through the Service, you represent and warrant that:

* The Content is your own original work, or you have the necessary rights and permissions to post it.

* Posting the Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person or entity.

4.2 License to MAGA

By posting Content, you grant MAGA a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, modify, and distribute your Content in connection with operating and improving the Service. You retain ownership of your Content.
4.3 MAGA's Rights

MAGA reserves the right, but is not obligated, to monitor, edit, or remove any Content at our sole discretion and without notice if we determine it violates these Terms or is otherwise harmful, offensive, or inappropriate.

4.4 MAGA's Own Content

All original content on the Service that is not user-generated — including graphics, text, logos, product imagery, and design — is the exclusive property of MAGA or is used with permission. You may not reproduce, distribute, modify, or use any such content, in whole or in part, for commercial purposes or personal gain without our express written consent.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

You additionally agree not to:

* Use the Service in any manner that could disable, overburden, damage, or impair it.

* Use automated tools, bots, scrapers, or scripts to access or interact with the Service without our prior written consent.

* Introduce viruses, malware, trojans, worms, or other technologically harmful material.

* Attempt to gain unauthorised access to any part of the Service, its servers, or any connected systems.

* Attack the Service via denial-of-service or distributed denial-of-service methods.

* Take any action intended to damage, falsify, or manipulate MAGA's reputation or ratings.

The Service is intended solely for individuals who are at least 18 years of age. By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the full legal capacity to enter into this Agreement. If you are under 18, you are prohibited from accessing or using the Service.

When you create an account with MAGA, you confirm that you are at least 18 years of age and that all information you provide is accurate, complete, and current. Providing inaccurate or misleading information may result in the immediate suspension or termination of your account.

You are responsible for maintaining the security and confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@maga.com if you become aware of any unauthorized access or security breach.

You may not use a username that impersonates another person, infringes on any trademark or intellectual property rights, or is offensive, vulgar, or obscene. MAGA reserves the right to refuse service, suspend or terminate accounts, remove or edit content, and cancel orders at our sole discretion, including where we believe a breach of these Terms has occurred.

The Service and all of its original content, features, and functionality are and will remain the exclusive property of MAGA and its licensors. The Service is protected by copyright, trademark, and other applicable laws. MAGA's trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MAGA.

MAGA respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that any content on the Service infringes your copyright, please submit a written notice to contact@maga.com with the subject line "Copyright Infringement". To be valid, your DMCA notice must include:

* An electronic or physical signature of the person authorised to act on behalf of the copyright owner.

By submitting feedback, you acknowledge that you retain no intellectual property rights in it, that MAGA may have independently developed similar ideas, and that MAGA is under no obligation of confidentiality. Where transfer of ownership is not possible under applicable law, you grant MAGA an irrevocable, perpetual, worldwide, royalty-free licence to use the feedback for any purpose.

We may use third-party service providers to monitor and analyse usage of the Service. These tools help us understand how users interact with the Service so we can improve it over time. Any data collected through analytics tools is handled in accordance with our Privacy Policy.

To the fullest extent permitted by applicable law, MAGA and its officers, directors, employees, and agents shall not be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in connection with your use of the Service, even if MAGA has been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless MAGA and its officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party rights, including intellectual property rights; or (iv) any Content you post on the Service.

MAGA may suspend or terminate your account and access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason including a breach of these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, please contact us at contact@maga.com.

All provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.

In the event of any dispute arising out of or in connection with these Terms or your use of the Service, both parties agree to first attempt to resolve the matter informally by contacting MAGA at contact@maga.com. If a resolution cannot be reached within 30 days, either party may pursue their available legal remedies. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of those rights.

MAGA reserves the right to modify, suspend, or discontinue the Service or any part of it at any time, without notice and without liability. We may also restrict access to parts of the Service, or the entire Service, to certain users from time to time.
